LIKUID.COM® provides web hosting services to its clients worldwide. We are responsible for protecting each client and providing the best possible service. All clients of LIKUID.COMare subject to these terms and conditions. LIKUID.COM® offers web hosting services to clients worldwide, and we are responsible for protecting each client and providing the best available services. All clients of LIKUID.COM® are subject to the following terms and conditions.

Article 1 - Application and Enforceability of General Terms and Conditions

  • 1.1 - This hosting contract applies to all provision and delivery of hosting services. Any contrary clause put forward by the client will therefore, in the absence of express acceptance, be unenforceable against LIKUID.COM, regardless of the time it may have been brought to the attention of the latter.
  • 1.2 - None of the clauses of this hosting contract, if not applied, may be interpreted or opposed as constituting a waiver by LIKUID.COM® to subsequently avail itself of the said conditions.

Article 2 - Object

  • 2.1 This hosting contract is intended to define the technical and financial conditions under which LIKUID.COM® undertakes towards the client.

Article 3: Means

  • 3.1 - The client's website is accessible to the general public via the Internet.
  • 3.2 - LIKUID.COM® provides the client with disk space, an unlimited number of email accounts, traffic, and a domain name. LIKUID.COMprovides technical support to the client by email/tickets only.

Article 4: Operating Conditions

  • 4.1 - LIKUID.COM® will strive to offer 24/7 access, but cannot guarantee it due to the nature of the network.

Article 5: Information to the client and Service Compliance

  • 5.1 - The client acknowledges having checked the suitability of the service for their needs and having received all the information and advice necessary to subscribe to this commitment knowingly.

Article 6: Obligations of LIKUID.COM

  • 6.1 LIKUID.COMundertakes to take all necessary care and diligence to provide a quality service.
  • 6.2 Ensure 24/7 server access every day of the year, except for possible technical or network incidents. In case of absolute necessity, LIKUID.COMreserves the right to interrupt the service for technical intervention to improve its operation or perform maintenance.
  • 6.3 - Intervene quickly in case of an incident.
  • 6.4 - Ensure the best possible quality of its tools and ensure the competence of its team.

Article 7: Liability of LIKUID.COM

  • 7.1 - LIKUID.COM® undertakes to take all reasonable precautions to ensure the physical protection of the data and programs entrusted to it by the client.
  • 7.2 - LIKUID.COM's liability will not be incurred in the following cases: - deterioration of the application by the client and/or failure to follow the advice given. - improper use of servers and software by the client. - partial or total destruction of information transmitted or stored as a result of errors attributable directly or indirectly to the client.
  • 7.3 - LIKUID.COM® cannot be held liable for the client's failure to comply with rules, laws, and public order and good morals at national and international levels.
  • 7.4 - Due to the characteristics of the Internet, which the client declares to be perfectly familiar with, LIKUID.COM® cannot be held liable for, in particular: - the content of the information transmitted, disseminated, or collected, their use and updating, as well as any file, including address files, as well as sound, text, images, shape elements, and data accessible on the site, in any capacity whatsoever. - any potential misuse of passwords, confidential codes, and, more generally, any sensitive information for the client. LIKUID.COM® cannot be held responsible for this management, which is the responsibility of the client. - indirect damages, i.e., all those that do not result directly and exclusively from the partial or total failure of the service provided by LIKUID.COM, such as commercial loss, loss of orders, harm to the brand image, any commercial disruption, loss of profits or clients (for example, the untimely disclosure of confidential information concerning them as a result of defects or hacking of the system), for which the client will be his own insurer or can take out appropriate insurance. Any action brought against the client by a third party constitutes indirect harm and, therefore, does not give rise to compensation. - In any case, the amount of damages that could be charged to LIKUID.COM® if its liability were engaged will be limited to the amount of the sums actually paid by the client to LIKUID.COM® for the part of the service for which LIKUID.COM's liability has been retained. - LIKUID.COM® undertakes to make every effort to ensure optimal service to the client, except in the event that the interruption of the service is expressly requested by a competent administrative or judicial authority.
  • 7.7 - LIKUID.COM® cannot be held responsible for the total or partial failure to fulfill an obligation and/or a failure of the operators of the transport networks to the Internet and in particular of its or their access providers. In this respect, LIKUID.COM® informs the client that its services are dependent on other technical operators and that its liability cannot be engaged for their failure. - All of 's personnel are committed to the company by an employment contract, which includes a confidentiality clause and a non-disclosure clause. - LIKUID.COM's technicians are limited to network/server support; they may decide not to respond to questions regarding the creation of codes/scripts not provided by CPanel.

Article 8: client's Obligations and Liability

  • 8.1 - The client acknowledges having verified the suitability of the service for their needs.
  • 8.2 - The client is responsible for their websites, the content of the information transmitted, disseminated, or collected on them, their use and updating, as well as any files they contain, including address files.
  • 8.3 - The client is responsible for the scripts and programs they use in their hosting space. They will ensure, in particular, that these programs do not cause failure or saturation (in terms of disk resources, CPU, or memory) of the servers on which they are deployed.
  • 8.4 - The client undertakes to respect the rights of third parties, in particular, the personality rights and intellectual property rights of third parties such as copyright, patent rights, or trademark rights.
  • 8.5 - The client must contact LIKUID.COMin the event of unintended domain name expiration.
  • 8.6 - The client must inquire and comply with LIKUID.COM's usage standards.

Article 9: Contract Duration

  • 9.1 - The contract is concluded for a period of 12 months from the date of order.
  • 9.2 - This contract is renewable for a period identical to that set at the time of its conclusion, according to the terms and rates practiced by LIKUID.COMon the date of its renewal, unless denounced by one of the parties under the conditions described below.

Article 10: Prices and Billing

  • 10.1 - All prices indicated include taxes and are payable in Canadian dollars.
  • 10.2 - The price set for the 12-month period is final; it is mentioned when ordering hosting.
  • 10.3 - During the 12-month period, the price cannot be revised.
  • 10.4 - Invoices are payable in advance for the period to come.

Article 11: Domain Name

  • 11.1 The domain name is the exclusive property of the client.
  • 11.2 The domain is free as long as the client renews their subscription with LIKUID.COM.

Article 12: Termination

  • 12.1 - The client may terminate the contract during the 7-day trial period. Following the 7-day trial period, the client may not request any refund from LIKUID.COM, whether they use the services or not. LIKUID.COMwill then retain 100% of the amounts paid by the client.
  • 12.2 - The client may request a refund during the 7-day trial period. A fee of $12.99 CAD will be deducted from the refund to cover the purchase of the domain name, if it was purchased by LIKUID.COMas part of the hosting. The client will receive access to manage their domain name directly from the registrar Bookmyname. Refunds are not applicable to dedicated servers.
  • 12.3 - LIKUID.COMand the client mutually undertake to notify each other by email of any breach of this contract.
  • 12.4 LIKUID.COMmay terminate this contract or suspend a client's hosting who displays illegal content on their site, without notice.

Article 13: Force Majeure

  • 13.1 - If the performance of the contract, or any obligation incumbent on LIKUID.COMunder these, is prevented, limited, or disturbed by fire, an explosion, a failure of transmission networks, a collapse of installations, an epidemic, an earthquake, a flood, a power failure, a war, an embargo, a law, an injunction, a request or requirement of any government, a strike, a failure of its network provider, or any other circumstance beyond the reasonable control of LIKUID.COM, then the latter will be exempt from its obligations.
  • 13.2 - In these cases, LIKUID.COMwill be exempt from the performance of its obligations to the extent of the prevention, limitation, or disturbance. In case of force majeure, LIKUID.COMmust regularly inform the client of the follow-up and prognosis for recovery.
  • 13.3 - The obligations arising from this contract will be suspended for the entire duration of the force majeure.
  • 13.4 - If the effects of a force majeure event were to last more than two months, the contract may be terminated automatically at the request of either party, without the right to compensation on either side.

Article 14: Confidentiality

  • 14.1 - Each party must consider as confidential, during the term of the contract and after its expiration, the information, documents, systems, know-how, formulas, or any data from the other party that it may have become aware of in the course of the contract, and must not disclose them to others or use them outside the needs of the contract.
  • 14.2 - LIKUID.COM's Privacy Policy is an integral part of this Agreement. See privacy policy.

Article 15: Account Backups

  • 15.1 - LIKUID.COMperforms daily backups of all shared hosting accounts. However, these backups are not guaranteed and are performed for disaster recovery purposes only. It is the client's responsibility to back up their data regularly. LIKUID.COMis not responsible for data loss.

Article 17: Affiliation

  • 16.1 - The client may become an affiliate of LIKUID.COMby referring new clients to LIKUID.COM. The client will receive a commission for each new client referred to LIKUID.COM.
